Agreement to Terms

By accessing or using Creator Earnings Track, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access the service.

Description of Service

Creator Earnings Track is a financial tracking, DM automation, and business management platform designed for Indian content creators. The service allows you to:

• Track brand deals and collaborations
• Generate and manage GST/PAN-compliant invoices
• Monitor payment statuses and overdue payments
• Analyze earnings and revenue streams
• Automate Instagram Direct Messages (Auto DM) via Meta's Official Graph API
• Manage bookings, leads, services, and reviews (Smart CRM)
• Track expenses and calculate net profit
• Use Manager/Agency Mode for multi-creator management

Instagram Auto DM & API Usage

By utilizing our Instagram Auto DM features, you explicitly agree to the following:

• Meta Compliance: You must comply with all Instagram Community Guidelines and Meta Developer Policies.
• Anti-Spam: You will not use the automation tools to send unsolicited spam, malicious links, or repetitive nuisance messages.
• Account Safety: We are not liable for any restrictions, shadowbans, or suspensions placed on your Instagram account by Meta due to aggressive or non-compliant use of automated messaging.
• Service Availability: The Auto DM service relies on the Instagram Graph API. We cannot guarantee 100% uptime if Meta experiences outages or revokes API access.

User Accounts

Account Creation

You must:

• Be at least 18 years old to create an account
• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the confidentiality of your account. Notify us immediately of any unauthorized use or security breach.

Service Availability

While we strive for maximum uptime and reliability:

• Features may be updated or improved with notice
• Scheduled maintenance windows may cause temporary downtime
• Third-party API changes (Meta, Razorpay) may affect functionality
• We recommend maintaining independent backups of your critical data

Acceptable Use

You agree NOT to:

• Use the service for any illegal purposes
• Violate any local, state, national, or international law
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload malicious code or content
• Impersonate others or misrepresent your affiliation
• Share your account credentials with others
• Use the service to harass, abuse, or harm others

Intellectual Property

All content, features, and functionality of Creator Earnings Track, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of akalloverservices and are protected by copyright, trademark, and other intellectual property laws.

Creator Earnings Track™ is a registered trademark of akalloverservices. You may not use this trademark without our prior written permission.

Content Ownership

You retain all rights to the data you input into Creator Earnings Track. By using our service, you grant us a license to use, store, and process your data solely for the purpose of providing and improving the service.

Pricing, Subscriptions & Refunds

Creator Earnings Track offers the following plans:

• 3-Day Free Trial: Full Pro access — no credit card required. Automatically reverts to Free plan after 3 days.
• Monthly Pro — ₹199/month: Unlimited deals, Auto DM, analytics, invoices, calendar, and overdue tracking.
• Yearly Pro — ₹1,499/year (₹125/month): Everything in Monthly + Smart CRM included free.
• Smart CRM Add-on — ₹99/month: Bookings, Leads, Services & Reviews for Monthly Pro users.

Payments are processed via Razorpay. All prices are in Indian Rupees (₹) and inclusive of applicable taxes. We reserve the right to modify pricing with 30 days advance notice.

Refund Policy

Due to the digital nature of the service, all payments are non-refundable once processed. You may cancel your subscription at any time, and it will remain active until the end of the current billing period.

Service Modifications

We reserve the right to modify or discontinue the service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.

You may delete your account at any time from your account settings. Upon account deletion, your data will be removed within 30 days.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The service will be uninterrupted or error-free
• Defects will be corrected
• The service is free of viruses or harmful components
• Results obtained from the service will be accurate or reliable

Limitation of Liability

IN NO EVENT SHALL CREATOR EARNINGS TRACK OR AKALLOVERSERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the past 12 months.

Indemnification

You agree to indemnify and hold harmless akalloverservices, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new Terms.
